Please read these Terms & Conditions ("Terms") carefully before using the OCC App website or mobile platform operated by Our Common Commute Inc. ("Company").

1. Acceptance of Terms

By creating an account, downloading, or using the OCC App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease using our Services.

2. Description of Platform

The OCC App provides digital mobility infrastructure to match riders with community, workforce mobility seevices. Our Common Commute Inc. is a technology platform connector and service operator, facilitating workforce transit.

3. User Accounts & Location Consent

Eligibility: You must be at least 18 years old (or have authorized guardian consent where applicable) to create an account.

Automatic Geolocation Consent: By using the OCC App, you explicitly consent to automatic real-time location tracking while using the platform. You acknowledge that this tracking is strictly required for matching rides, optimizing transit routes, verifying pickups, and maintaining safety and service quality.

Account Conduct: You agree to provide accurate registration information and maintain the security of your account credentials. You are responsible for all activities occurring under your account.

4. Prohibited Activities

You agree NOT to:

  • Use the app for any unlawful purpose or unauthorized commercial solicitation.
  • Impersonate another user, bypass security features, or scrape data from the platform.
  • Interfere with device location signals or tamper with platform tracking functions.

5. Termination

We reserve the right to suspend or terminate your access to the OCC App at our sole discretion, without prior notice, for conduct that violates these Terms or harms other users, drivers, or our legal interests.

6. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Alabama and applicable federal laws of the United States, without regard to conflict of law principles. Any legal action or dispute arising under these Terms shall be resolved through binding individual arbitration or in state/federal court located in Barbour County, Alabama.

1. "As-Is" Service Provision

The OCC App, website, and all underlying software are provided on an "AS IS" and "AS AVAILABLE" basis. Our Common Commute Inc. makes no express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

2. Limitation of Liability

To the maximum extent permitted by law in all 50 U.S. states and territories, Our Common Commute Inc., its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of time, lost wages, personal property damage, or delays resulting from ride-matching availability or traffic disruptions.

3. GPS & Location Accuracy Disclaimer

While location tracking is utilized automatically for ride-matching and quality control, Our Common Commute Inc. does not guarantee 100% precision, continuous uptime, or uninterrupted cellular/GPS satellite coverage. Users acknowledge that external factors (e.g., weather, signal towers, device hardware) may impact real-time tracking accuracy.
